Reader Room Terms Of Use
- 1. Introduction
- The terms and conditions contained in this page (Terms) and the Terms and Conditions available at https://standards.org.au/terms-and-conditions (SA Terms and Conditions) govern the access and use by users of the Reader Room application (Reader Room). The Reader Room is a public benefit online portal, made available by Standards Australia Limited (ABN 85 087 326 690) (Standards Australia or SA) to provide Australian residents no-fee access to selected Australian Standard® standards and other publications for certain non-commercial uses only.
- 2. Agreement
- 2.1. Legal agreement and representation. These Terms form a legal agreement between a user of the Reader Room (you) and Standards Australia. You may only access the Reader Room for personal use, and you may not access the Reader Room on behalf an organisation or entity.
- 2.2. Acceptance. By accessing or using the Reader Room, you accept and agree to comply with the Terms and the SA Terms and Conditions in their entirety.
- 2.3. Modification. Standards Australia may at any time, in its sole discretion, amend, vary or modify these Terms without notice. Modifications to these Terms will be effective immediately and any subsequent use by you of the Reader Room will constitute your acceptance of the modifications and the then-current Terms.
- 3. Privacy and personal information
- 3.1. Privacy Policy. Any information (including personal information) that you provide by accessing or using the Reader Room will be dealt with in accordance with these Terms and Standards Australia’s Privacy Policy (as updated from time to time).
- 3.2. Communications. You agree that Standards Australia may contact you, including to an email address you provide or by other means, with information regarding Standards Australia or your use of the Reader Room. You can manage or opt-out of receiving such communications via your personal settings or clicking an unsubscribe link in the relevant communications.
- 4. Content you submit
- 4.1. Prohibited activities. You must not attempt to:
- 4.1.1. introduce any virus or other damaging material into the Reader Room;
- 4.1.2. infringe or breach the rights of a third party (including intellectual property, copyright, confidentiality or privacy rights);
- 4.1.3. do anything that may be deceptive or misleading, primarily used to promote your or a third party business or enterprise, involves or promotes any illegal activity, or is otherwise contrary to any applicable laws, codes or policies of Standards Australia, or any other agreement you have with Standards Australia.
- 5. Intellectual Property
- 5.1. Our content. Standards Australia may provide you with access to content and resources as part of the Reader Room (such as standards and technical publications).
- 5.2. Ownership. Copyright in content included in or made available via the Reader Room remains vested in Standards Australia (or relevant third parties, such as other standards development bodies or external providers who may have licensed such content to Standards Australia).
- 5.3. Protection. You agree to protect Standards Australia content in your possession or control from unauthorised use.
- 5.4. Permitted use. Standards Australia grants you a non-exclusive, non-sub-licensable, non-transferable, and revocable licence to use the content accessible via the Reader Room, but only if such use by you is:
- 5.4.1 strictly for personal and non-commercial use; and
- 5.4.2. in accordance with these Terms.
- 5.5. Restrictions. Other than the permitted use in clause 5.4, you must not (and must not attempt to):
- 5.5.1. use, reproduce, copy, merge, adapt, translate, embed, modify, rent, lease, sell, sublicense, send by email, share, distribute, upload to a website, assign or otherwise transfer any content obtained from the Reader Room, unless with the prior written permission from Standards Australia or the relevant third party owners;
- 5.5.2. remove, alter or obscure any copyright or licence notices appearing on our content (including without limitation any watermark); or
- 5.5.3. bypass, modify or circumvent any security-related features or content protection or features applicable to our content.
- 6. Registration and access
- 6.1. Single-user licence. The licence to access the Reader Room granted by Standards Australia to you pursuant to clause 5.4 is a single-user licence personal to you and may not be transferred to another individual or organisation.
- 6.2. Registration. Subject to the SA Terms and Conditions, you must provide Standards Australia with accurate and up-to-date registration information.
- 6.2.1. You must not impersonate or create an account for any other person, and you agree to inform Standards Australia of any changes
- 6.2.2. Account registration for access to the Reader Room first requires verification through an Australian mobile phone number.
- 6.3. Password. You must keep your password(s) for your Reader Room account secure and confidential and not to disclose it to any other person. You must immediately notify us if you have lost your password, if your password is compromised, or if you become aware of any unauthorised access to the Reader Room using your login details.
- 6.4. Applicable laws. You must comply with all applicable laws and regulations when using any Reader Room, including intellectual property, privacy, anti-discrimination and criminal laws. You must not disassemble, decompile or reverse engineer the software or source code of any Reader Room.
- 6.5. Surveillance. Standards Australia reserves the right to monitor and review your use of the Reader Room (for example to prevent copyright infringement).
- 6.6. Multi-Factor Authentication. To address certain cybersecurity concerns, you agree to authenticate your access to the Reader Room through multi-factor authentication mechanisms.
- 6.1. Single-user licence. The licence to access the Reader Room granted by Standards Australia to you pursuant to clause 5.4 is a single-user licence personal to you and may not be transferred to another individual or organisation.
- 7. Additional Requirements for Reader Room
- 7.1. The Reader Room is an online portal containing selected Australian Standard® standards and other publications in Web-Reader PDF format (Reader Room Publications and each a Reader Room Publication), provided to members of the public in Australia on a no-fee access basis for personal, domestic or household use only.
- 7.2. You acknowledge that the Reader Room is provided no-fee basis and agree that your use of the Reader Room is solely at your own risk, pursuant to clause 8 and 9.2 below.
- 7.3. Reader Room Access:
- 7.3.1. Any Reader Room Publication is provided on a read-only basis. You may not download or otherwise save or reproduce any Reader Room Publication.
- 7.3.2. You are granted three (3) unique access tokens, over a 12-month period, to access Reader Room Publications. Each unique access token grants you access to one (1) Reader Room Publication for a 24-hour period.
- 7.4 You may not use any Reader Room Publications for any commercial application or purpose, or attempt to sell, rent, distribute, or sublicence any Reader Room Publications to any party.
- 7.5 Standards Australia reserves the right to:
- 7.5.1. update the version of any Reader Room Publication;
- 7.5.2. include or withdraw any Reader Room Publication; or
- 7.5.3. cease providing access to the Reader Room, at any time and at its sole discretion.
- 7.6. Reader Room Publications are subject to copyright. Any reproduction, copying or distribution of the Reader Room Publications (including by way of “Printscreen”, “Screen Snip”, “Print as PDF”), unless permitted under these Terms, is strictly prohibited.
- 8. No warranty
- 8.1. Standards Australia does not guarantee that access to any Reader Room will be uninterrupted or that the Reader Room is free from viruses or anything else which may damage any computer which accesses the Reader Room or any data on such a computer.
- 8.2. To the maximum extent permitted by law, Standards Australia expressly excludes all conditions and warranties, guarantees, rights and remedies, liabilities and other terms that may be implied by custom, statute or common law that may relate to the Reader Room.
- 8.3. To the maximum extent permitted by law, Standards Australia excludes all liability for any loss or damage of any kind, whether under contract, tort (including negligence) or otherwise, whether direct, indirect, special, or consequential loss (including any loss of revenue or profits, loss of anticipated savings, loss of data, loss of value of equipment, any penalties or fines imposed by a regulator), arising in any way out of or in connection with your use of the Reader Room.
- 8.1. Standards Australia does not guarantee that access to any Reader Room will be uninterrupted or that the Reader Room is free from viruses or anything else which may damage any computer which accesses the Reader Room or any data on such a computer.
- 9. Termination
- 9.1. Standards Australia reserves the right to terminate your access to any Reader Room at any time and without notice, including if Standards Australia believes you have breached the Terms or are no longer an active user.
- 9.2. Standards Australia may terminate, suspend or modify the Reader Room (or any part of it) at any time without notice, including without limitation for upgrades and scheduled maintenance.
- 9.1. Standards Australia reserves the right to terminate your access to any Reader Room at any time and without notice, including if Standards Australia believes you have breached the Terms or are no longer an active user.
- 10. Jurisdiction
